Welcome to Aura SkyPool. These Terms of Service ("Terms") govern your access to and use of our services, including our website, booking platform, and all related services provided by Aura SkyPool. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully before proceeding.

1. Acceptance of Terms

By creating an account, making a booking, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy. If you do not agree with any part of these Terms, you must not use our services.

These Terms constitute a legally binding agreement between you ("User", "Guest", "you", or "your") and Aura SkyPool ("we", "us", "our", or "Company"). We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.

2. Service Description

Aura SkyPool provides premium leisure and entertainment services in Dubai, United Arab Emirates, including but not limited to:

  • Sky Pool Access: Entry to our world-class rooftop infinity pool with panoramic views of Dubai's skyline
  • Luxury Amenities: Access to premium facilities including changing rooms, showers, lockers, and relaxation areas
  • Food and Beverage Services: Restaurant and bar services offering international cuisine and premium beverages
  • Special Events: Sunset sessions, DJ performances, and exclusive private events
  • City Tours: Curated experiences showcasing Dubai's best attractions and landmarks
  • VIP Packages: Premium cabana rentals, private pool areas, and personalized concierge services

All services are subject to availability and may be modified, suspended, or discontinued at any time without prior notice. We strive to provide accurate descriptions of our services, but we do not warrant that service descriptions or other content on our website are accurate, complete, reliable, current, or error-free.

3. Booking and Reservations

3.1 Booking Process

To make a reservation, you must provide accurate and complete information, including your full name, contact details, payment information, and any special requirements. You are responsible for ensuring that all information provided is current and accurate. Any false or misleading information may result in the cancellation of your booking without refund.

3.2 Booking Confirmation

Once your booking is completed and payment is processed, you will receive a confirmation email containing your booking details, reference number, and entry instructions. This confirmation serves as your proof of purchase and must be presented upon arrival, either in printed form or on a mobile device.

3.3 Special Offers and Promotions

Our first-time guest promotion offering 50% off for bookings made within one hour is subject to the following conditions:

  • Valid only for new customers who have never previously booked with Aura SkyPool
  • Booking must be completed within 60 minutes of initial website visit
  • Discount applies to standard admission tickets only and cannot be combined with other offers
  • Subject to availability and blackout dates during peak seasons and special events
  • Promotion may be modified or terminated at any time without prior notice
  • One-time use per customer; verification may be required

3.4 Payment Terms

All bookings require full payment at the time of reservation. We accept major credit cards, debit cards, and other payment methods as displayed on our website. Prices are quoted in UAE Dirhams (AED) and include applicable taxes unless otherwise stated. You authorize us to charge your payment method for the total amount of your booking, including any additional services or amenities selected.

Important: Payment information is processed through secure, encrypted channels. We do not store complete credit card information on our servers. All transactions are subject to fraud detection and verification procedures.

4. Cancellation and Refund Policy

4.1 Cancellation by Guest

Cancellations must be made through our website or by contacting our customer service team. The following cancellation terms apply:

  • More than 48 hours before scheduled visit: Full refund minus 10% administrative fee
  • 24-48 hours before scheduled visit: 50% refund of total booking amount
  • Less than 24 hours before scheduled visit: No refund available
  • No-show: No refund and booking is forfeited

Refunds will be processed to the original payment method within 7-14 business days. Special promotional rates and discounted bookings may be subject to different cancellation terms, which will be clearly communicated at the time of booking.

4.2 Cancellation by Aura SkyPool

We reserve the right to cancel or reschedule bookings due to circumstances including but not limited to:

  • Severe weather conditions affecting safety
  • Facility maintenance or emergency repairs
  • Government regulations or restrictions
  • Force majeure events beyond our reasonable control

In the event of cancellation by Aura SkyPool, guests will receive a full refund or the option to reschedule to an alternative date at no additional charge. We will make reasonable efforts to notify you as soon as possible, but we are not liable for any consequential losses or expenses incurred.

5. Guest Conduct and House Rules

5.1 Age Requirements

Guests must be at least 21 years of age to access Aura SkyPool facilities. Valid government-issued photo identification must be presented upon entry. Guests under 21 years of age will be denied entry without refund. We strictly enforce this policy to maintain the premium adult atmosphere of our venue.

5.2 Dress Code

Appropriate swimwear is required in pool areas. We maintain a sophisticated atmosphere and reserve the right to refuse entry to guests whose attire is deemed inappropriate. Beachwear is acceptable in pool areas, but proper casual attire is required in restaurant and bar areas. Shoes must be worn in all non-pool areas.

5.3 Prohibited Conduct

The following behaviors are strictly prohibited and may result in immediate removal from the premises without refund:

  • Disorderly, disruptive, or aggressive behavior toward staff or other guests
  • Excessive intoxication or substance abuse
  • Smoking in non-designated areas (including electronic cigarettes and vaping devices)
  • Photography or videography for commercial purposes without prior written consent
  • Bringing outside food or beverages onto the premises
  • Diving, running, or other unsafe behavior in pool areas
  • Damage to property or facilities
  • Harassment of any kind, including but not limited to sexual harassment

5.4 Safety and Security

For the safety and security of all guests, we maintain comprehensive surveillance systems throughout our facilities. By entering Aura SkyPool, you consent to being recorded. Security personnel have the authority to inspect bags and personal belongings. We reserve the right to refuse entry or remove any guest who poses a safety risk or violates our policies.

6. Liability and Assumption of Risk

6.1 Assumption of Risk

By using our facilities, you acknowledge and accept the inherent risks associated with swimming, water activities, and rooftop venues. You agree to use our facilities at your own risk and accept full responsibility for any injury, loss, or damage that may occur during your visit, except where such injury, loss, or damage is caused by our gross negligence or willful misconduct.

6.2 Limitation of Liability

To the maximum extent permitted by law, Aura SkyPool, its parent company, affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:

  • Your access to or use of or inability to access or use our services
  • Any conduct or content of any third party on our premises
  • Unauthorized access, use, or alteration of your bookings or personal information
  • Loss or theft of personal belongings
  • Injuries sustained while using our facilities

Our total liability to you for all claims arising from or related to these Terms or your use of our services shall not exceed the amount you paid for the specific service giving rise to the claim.

6.3 Indemnification

You agree to indemnify, defend, and hold harmless Aura SkyPool and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your use of our services, or your violation of any rights of another party.

7. Intellectual Property Rights

7.1 Ownership

All content on our website and within our facilities, including but not limited to text, graphics, logos, images, videos, audio clips, digital downloads, and software, is the property of Aura SkyPool or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our website and services for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our website without our prior written consent.

7.3 User-Generated Content

By posting photos, reviews, or other content on our social media platforms or website, you grant Aura SkyPool a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for marketing and promotional purposes. You represent and warrant that you own or have the necessary rights to grant this license.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

9. Third-Party Services and Links

Our website may contain links to third-party websites, services, or resources that are not owned or controlled by Aura SkyPool. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services.

We may partner with third-party service providers for payment processing, booking management, and other operational services. These providers are bound by confidentiality agreements and are prohibited from using your personal information for any purpose other than providing services to us.

10. Force Majeure

Aura SkyPool shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to:

  • Acts of God, natural disasters, severe weather conditions
  • War, terrorism, civil unrest, or government actions
  • Pandemics, epidemics, or public health emergencies
  • Strikes, labor disputes, or supply chain disruptions
  • Utility failures, telecommunications outages, or cyber attacks
  • Changes in laws, regulations, or government policies

In such events, our obligations will be suspended for the duration of the force majeure event, and we will make reasonable efforts to minimize the impact on our guests.

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates and the Emirate of Dubai, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Dubai, and you hereby consent to personal jurisdiction and venue therein.

11.2 Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or your use of our services, the parties agree to first attempt to resolve the matter through good faith negotiations. If the dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to binding arbitration in accordance with the arbitration rules of the Dubai International Arbitration Centre (DIAC).

11.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Modifications to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. Material changes will be notified to registered users via email at least 30 days prior to the effective date. Your continued use of our services after any modifications indicates your acceptance of the updated Terms.

It is your responsibility to review these Terms periodically for changes. If you do not agree to the modified Terms, you must discontinue your use of our services immediately.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable. The failure of either party to exercise any right provided for herein shall not be deemed a waiver of any further rights hereunder.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on our website, constitute the entire agreement between you and Aura SkyPool concerning your use of our services and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us.

15. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

16. Survival

All provisions of these Terms which by their nature should survive termination shall survive termination, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Acknowledgment: By using Aura SkyPool services, you acknowledge that you have read these Terms of Service, understand them, and agree to be bound by them. If you do not agree to these Terms, you are not authorized to use our services.
